CHARITABLE PARTNERSHIP DISCLOSURE: This Event is a commercial co-venture between Avia Games Inc. (for-profit company) and Foster Love, a 501(c)(3) tax-exempt charitable organization. For every 100 Wish Stars earned by players, Avia Games Inc. will donate USD $0.02 to Foster Love.
The Wonderland Wishes Charity Event (the "Event") is open only to legal residents of the United States who are 18 years of age or older as of the date of participation ("Participant"), EXCLUDING residents of Alabama, Massachusetts, Connecticut, Hawaii, South Carolina, Illinois, Virginia, Mississippi and Arkansas. Each Participant must have an active Avia account in good standing at the time of participation. This Event may not be available to all users. Sponsor reserves the right to determine Event accessibility at its sole discretion based on various operational factors. Availability is subject to change without prior notice. Void where prohibited by law. Employees of Avia Games Inc. (the "Sponsor"), Foster Love, and their respective subsidiaries, parent companies, divisions, affiliates, advertising and promotion agencies (collectively, the "Released Event Parties") as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, are not eligible to participate. This Event is subject to all applicable federal, state, and local laws and regulations. Participation constitutes Participant's full and unconditional agreement to these Official Terms.
The Event begins on November 30, 2025 and ends on January 03, 2026 ("Event Period").
During the Event Period, Participants can:
Foster Love is a tax-exempt charitable organization under Section 501(c)(3) of the Internal Revenue Code. Foster Love's mission is to improve the lives of children in foster care by providing essential resources, emotional support, and enriching experiences that promote dignity, normalcy, and long-term success. Sponsor recognizes the importance of supporting vulnerable children and seeks to leverage its gaming platform to engage players in furthering Foster Love's charitable programs.
Avia Games Inc. will make a charitable donation to Foster Love based on player engagement during the "Wonderland Wishes" charity event. The donation will be calculated at USD $0.02 for every 100 Stars collected by a player. The final donation amount is calculated based on each player's individual total number of Stars collected
Participants may complete daily tasks to earn virtual "Wish Stars." Upon accumulating 100 Wish Stars (i.e., reaching a progress of 100/100), an in-game "Donation" action will be automatically triggered, the progress bar will reset to 0/100, and the Participant may immediately commence a new donation cycle.
The actual final donation amount will be determined solely by verified player engagement data as recorded by Sponsor's gaming platform during the Event Period, and the final amount may vary from this estimate depending on actual player participation levels.
By participating, each Participant agrees to: (a) comply with and be bound by these Official Terms and decisions of Sponsor; (b) receive communications related to the Event electronically; (c) release and hold harmless the Released Event Parties from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy, defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to Participant's participation in the Event, acceptance or use or misuse of any prize and/or any related activities; and (d) indemnify, defend and hold harmless Released Event Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney's fees) arising out of or relating to Participant's participation in the Event and/or acceptance, use or misuse of any prize.
Except where prohibited, participation in the Event constitutes consent to Sponsor's and Foster Love's use of Participant's name, likeness, photograph, voice, opinions and/or hometown and state for promotional, advertising, marketing purposes in any media, worldwide, without further notice, payment or consideration.
Except where prohibited, by participating in the Event, Participants agree to release and hold harmless Released Event Parties from and against any claim or cause of action arising out of participation in the Event or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Event; (b) technical errors related to computers, servers, providers, or network lines; (c) errors in the administration of the Event or processing of participation; (d) late, lost, or undeliverable communications; (e) any defect in a prize or inability to participate in the Event; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant's participation in the Event, receipt, acceptance, delivery, possession, use or misuse of any prize. Participant further agrees that in any cause of action, the Released Event Parties' liability will be limited to the cost of participating in the Event and in no event shall the Released Event Parties be liable for attorneys' fees. Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
By participating in the Event, Participant fully and unconditionally agrees to and accepts these Official Terms and the decisions of the Sponsor, whose decisions are final and binding in all matters related to the Event. Sponsor is not responsible for any compatibility issues with Participant's device/browser used for Event participation. Sponsor is not responsible for lost, interrupted or unavailable network server or other connection; miscommunications; failed computer or telephone transmissions; technical failure; jumbled, scrambled or misdirected transmissions; or other error of any kind whether human, mechanical, or electronic.
CAUTION: If this Event is compromised or impaired in any way for any reason, including but not limited to, fraud, virus, bug, unauthorized human intervention, outbreak of widespread illness, pandemic, civil unrest or any other problem or causes beyond the control of Sponsor that corrupts or impairs the administration, security, fairness, or proper conduct of the Event, Sponsor reserves the right in its sole discretion to suspend or terminate the Event.
Any attempt to tamper with, interfere with, or manipulate the Event process, including, but not limited to, the use of AI, bots, automated systems, or fraudulent identities, is strictly prohibited. Any such actions may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to not only disqualify such individual but seek damages from such individual to the fullest extent permitted by law. Furthermore, any Participant that acts in an unsportsmanlike or disruptive manner will be disqualified.
Participant agrees that: (a) claims arising out of or connected with this Event shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in California; (b) Participant submits to sole and exclusive personal jurisdiction to said courts for any such dispute; (c) any and all claims, judgments, and awards shall be limited to actual damages of no more than $100; and (d) under no circumstances will Participant be permitted to obtain awards for and Participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses. All issues concerning the construction, validity, interpretation and enforceability of these Official Terms shall be governed by the laws of the State of California.
Information collected by Sponsor in connection with this Event will be used and shared in accordance with Sponsor's Privacy Policy. Participant agrees to the collection, processing and storage of their personal data by Sponsor for the purposes of the Event.
Sponsor may suspend, modify, or cancel the Event or these Terms at any time, including if fraud, technical issues, or other factors impair integrity.
